This Privacy Notice for Maximus Voice LLC (doing business as Maximus) ("we," "us," or "our") describes how and why we access, collect, store, use, and/or share ("process") your personal information when you use our services ("Services"), including when you:

  • Visit our website at https://www.maximus.work or any website of ours that links to this Privacy Notice

  • Download and use the Maximus mobile application (when available), or any other application of ours that links to this Privacy Notice

  • Use Maximus, a voice-first personal information management and life coordination service for adult consumers and employer-sponsored users in the United States. You interact with Maximus primarily through (i) real-time voice conversations with an AI assistant accessed through a responsive website and, in future releases, native mobile applications, and (ii) SMS text messaging. Current functionality includes voice-based capture and retrieval of user-dictated personal information, including commitments, recurring obligations, names, plans, and other notes; a personal cash flow journal in which you verbally record spending, money owed, and money you are owed; and a daily morning text message synthesizing items you have previously captured together with an open-ended prompt for a brief voice check-in.

How do we process your information? We process your information to provide, improve, and administer the Services, communicate with you, support security and fraud prevention, and comply with law. We process information only when we have a valid legal basis. Learn more in Section 2.

In what situations and with which parties do we share personal information? We share information with service providers necessary to operate the Services (including payment processing, voice AI infrastructure, SMS delivery, and cloud hosting) under contractual restrictions, and in limited circumstances such as legal compliance and business transfers. How do we keep your information safe? We use organizational and technical measures designed to protect your personal information. No system can guarantee complete security, but we work to maintain appropriate safeguards. Learn more in Section 8.

1. WHAT INFORMATION DO WE COLLECT?

In Short: We collect personal information that you provide to us directly, including information you provide in voice conversations and SMS messages with the Services. We also collect basic technical and usage information automatically when you use the Services.

Personal information you disclose to us

We collect personal information that you voluntarily provide to us when you register for the Services, use the Services, contact us, or otherwise interact with us.

Account and contact information:

  • Names

  • Phone numbers

  • Email addresses

  • Contact preferences (such as preferred briefing time)

Content you provide through the Services:

  • Voice recordings and audio data captured during conversations with the Maximus AI assistant

  • Transcripts of voice conversations generated by speech-to-text processing

  • Content of SMS text messages exchanged with the Services

  • Financial information you verbally provide, including transactions, amounts you owe, amounts owed to you, and commitments related to money

  • Information about third parties referenced in conversations, including names and details of family members, coworkers, members of your crew, and others you mention

  • Health and wellness information you voluntarily provide, including information about training, sleep, physical activity, and related topics

Sensitive Personal Information

When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive personal information:

  • Financial data that you verbally share during conversations

  • Health data that you voluntarily provide

  • Biometric data in the form of voice recordings. Although our service uses voice recordings as the medium of interaction, we do not use voice recordings to identify or authenticate users and we do not generate or store voiceprints for biometric identification purposes

Voice conversations may, at your discretion, contain information touching on other sensitive categories such as racial or ethnic origin, religious or philosophical beliefs, political opinions, or sexual orientation. We do not solicit such information, and we do not process it for any purpose related to its sensitive nature.

Payment data

We collect data necessary to process your subscription payment. All payment data is handled and stored by our payment processor, Stripe. We do not store or retain full debit or credit card numbers. You can review Stripe's privacy notice at https://stripe.com/privacy.

Service usage data

When you use the Services, we automatically collect certain information about your device and your interactions with the Services, including IP address, browser type, operating system, device identifiers, and usage logs. This information helps us operate, secure, and improve the Services.

All personal information that you provide to us must be true, complete, and accurate. You must notify us of any changes to your personal information.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, support security and fraud prevention, and comply with law.

We process your personal information for the following purposes:

  • To provide and operate the Services, including processing voice conversations, generating transcripts, delivering SMS briefings, maintaining your records, and providing the features you use.

  • To facilitate account creation, authentication, and management, including verifying your phone number, maintaining your account, and providing access to the Services.

  • To process subscription payments and manage your subscription, including processing renewals, upgrades, downgrades, and cancellations.

  • To communicate with you about the Services, including sending administrative information, responding to inquiries, providing support, and notifying you of changes to our terms or policies.

  • To improve the Services, including identifying usage trends, evaluating feature performance, and developing new functionality. Where we use personal information for service improvement, we do so under appropriate safeguards including, where feasible, the use of aggregated or de-identified data.

  • For security, fraud prevention, and to enforce our terms, including detecting and preventing fraudulent activity, abuse, and unauthorized access.

  • To comply with legal obligations, including responding to lawful requests from public authorities and establishing or defending legal claims.

  • For other purposes with your prior consent.

We do not process your personal information for advertising or marketing by third parties, and we do not sell your personal information.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We process your personal information only when we have a valid legal basis to do so under applicable law.

We process personal information based on one or more of the following:

  • Performance of a contract: Processing necessary to provide you with the Services you have requested.

  • Legitimate interests: Processing necessary for our legitimate interests in operating, securing, and improving the Services, where those interests are not overridden by your rights.

  • Legal obligation: Processing necessary to comply with applicable law.

  • Consent: Processing based on your express consent, including for sensitive personal information. You may withdraw your consent at any time as described in Section 10.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We share personal information only with service providers necessary to operate the Services and in limited other circumstances. We do not sell your personal information, and we do not share it with advertisers, data brokers, or marketing partners.

SMS messaging and your mobile information. Mobile information collected when you opt in to receive SMS messages from Maximus, including your mobile phone number and SMS consent records, will not be shared with third parties or affiliates for marketing or promotional purposes. The only third party with whom we share your mobile phone number is Twilio, our SMS service provider, solely for the purpose of delivering messages to you. SMS opt-in data is not sold, shared, or otherwise disclosed to advertisers, data brokers, or marketing partners. You may opt out of SMS messages at any time by replying STOP to any message from Maximus. You may also reply HELP for support. Message frequency varies. Message and data rates may apply.

Service providers

We share personal information with service providers and subprocessors who help us operate the Services, under written contracts that restrict their use of your information to the purposes we authorize. Our current service providers include:

  • Voice AI infrastructure: Deepgram — orchestrates real-time voice conversations.

  • Speech-to-text: Deepgram — converts voice recordings into text.

  • Large language model: Anthropic or OpenAI — generates AI assistant responses and synthesizes content.

  • Text-to-speech: Deepgram — generates the spoken responses you hear.

  • SMS messaging: Twilio — transmits text messages between you and the Services.

  • Cloud hosting, database, and authentication: Supabase — stores and processes your account information and conversation records.

  • Payment processing: Stripe — handles subscription billing.

We update this list as our service provider relationships change.

Other sharing

We may share personal information in the following limited additional circumstances:

  • Legal compliance: Where required by law, regulation, legal process, or governmental request, or to establish or defend legal claims.

  • Business transfers: In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business. Any successor entity will be bound by this Privacy Notice or will provide notice before changing its terms.

  • With your consent: For any other purpose disclosed to you and to which you consent.

Employer-sponsored users

If your access to the Services is sponsored by an employer or organization, that employer or organization receives only aggregated, de-identified information about service usage and outcomes across its sponsored users. Your individual voice recordings, transcripts, SMS messages, and personal data are never shared with the sponsoring employer. With your express consent, a sponsoring employer may provide a limited knowledge store (such as benefits information or internal contact directories) for the Services to make available to you.

What we do not do

We do not sell your personal information, and we have not done so in the preceding twelve (12) months. We do not share your personal information with advertisers, data brokers, ad networks, or marketing partners. We do not authorize our AI service providers to use your personal information to train their own AI models. We commit not to engage in these practices in the future.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We use a limited set of cookies and similar technologies necessary to provide the Services. We do not use advertising or tracking cookies, and we do not permit third-party advertising on the Services.

We use cookies and similar technologies for the following limited purposes:

  • Essential cookies: Required to authenticate users, maintain session state, prevent fraud, and provide core functionality of the Services. These cookies cannot be disabled without breaking the Services.

  • Functional cookies: Used to remember your preferences and settings.

We do not use third-party advertising cookies. We do not use tracking pixels or web beacons that share data with advertisers. We do not participate in cross-site behavioral tracking or programmatic advertising networks. We do not send marketing communications based on browsing behavior.

You may configure your browser to refuse cookies or to alert you when cookies are being sent. If you do so, some parts of the Services may not function correctly.

6. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?

In Short: Yes. The Services are built around artificial intelligence and machine learning technologies. AI processing is necessary to provide the Services. The Services are AI-native: voice recognition, language understanding, response generation, and content synthesis are core functions, not optional features.

Functions of our AI-based services

Our AI-based services perform the following functions:

  • Voice recognition and speech-to-text conversion

  • Natural language understanding and conversational AI

  • Text analysis of user conversations and messages

  • Content generation, including summaries and morning briefings

  • Future planned functions including task automation, drafting assistance, and pattern recognition across user-provided content

Third-party AI service providers

We rely on third-party AI service providers to deliver these functions. Your voice recordings, transcripts, and other inputs are transmitted to and processed by these providers for the purpose of providing the Services to you. Our current AI service providers are identified in Section 4.

We do not authorize our AI service providers to use your personal information to train their own AI models.

How to opt out of AI processing

AI processing is intrinsic to the Services. We cannot deliver the Services without it. If you do not want your personal information processed by AI, you should not use the Services. You can stop AI processing at any time by:

  • Ending your conversation with the Maximus AI assistant

  • Deleting your account, which will end ongoing processing and delete your data subject to the retention provisions in Section 7

  • Replying STOP to any SMS message from the Services, which will end SMS-based interactions

You have the right to limit certain uses of your sensitive personal information as described in Section 12.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as your account is active and delete it within 30 days of account termination, except where longer retention is required by law or necessary to resolve disputes. Information in backup systems is expunged within 90 days of account termination.

We retain your personal information for as long as your account is active and for as long as necessary to provide the Services to you. When you delete your account, or when we close your account for any reason, we will delete the personal information associated with your account from our active production systems within 30 days.

Information that remains in backup or archival systems will be expunged on a rolling basis as those systems are overwritten, and in any case within 90 days of account termination.

We may retain certain information for longer periods where required by law (including tax, accounting, and recordkeeping obligations), where necessary to resolve disputes, prevent fraud, enforce our agreements, or establish or defend legal claims. Where this applies, we retain only the specific information necessary for those purposes.

Aggregated and de-identified information that no longer identifies you may be retained indefinitely.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We use organizational and technical safeguards designed to protect your personal information.

We have implemented appropriate and reasonable technical and organizational measures designed to protect the security of your personal information, including encryption of data in transit and at rest, access controls, and contractual security commitments with our service providers.

No transmission over the internet and no information storage technology can be guaranteed to be completely secure. We cannot promise that unauthorized parties will never be able to defeat our safeguards. Transmission of personal information to and from our Services is at your own risk. Access the Services only within a secure environment.

9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: No. The Services are for adults aged 18 and older. We do not knowingly collect personal information from anyone under 18.

We do not knowingly collect, solicit, or process personal information from children under 18 years of age. We do not knowingly sell or share information about anyone under 18. By using the Services, you represent that you are at least 18 years of age.

We do not knowingly send SMS messages to phone numbers belonging to anyone under 18. If we become aware that a phone number associated with our Services belongs to a minor, we will immediately remove that number from all SMS distribution and terminate the associated account. If we learn that we have collected personal information from a person under 18, we will promptly delete that information and terminate the associated account. If you believe we may have collected information from a person under 18, please contact us at privacy@maximus.work.

10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on where you live, you may have rights regarding your personal information. You may exercise these rights at any time by contacting us.

Depending on your jurisdiction, applicable data protection laws may give you the following rights:

  • The right to access and obtain a copy of your personal information

  • The right to correct inaccuracies in your personal information

  • The right to request deletion of your personal information

  • The right to data portability

  • The right to opt out of certain processing, including profiling and automated decision-making that produces legal or similarly significant effects

  • The right to limit use and disclosure of your sensitive personal information

  • The right to withdraw consent where processing is based on consent

  • The right to not be subject to solely automated decisions with legal or similarly significant effects

Some Maximus features involve automated processing, but we do not make solely automated decisions about you that produce legal or similarly significant effects. If we ever do, we will provide notice and offer human review.

Account deletion

You may delete your account at any time by sending a deletion request from the email address associated with your account to privacy@maximus.work.

We will close your account and delete the personal information associated with it within 30 days of receiving your request, subject to the retention provisions in Section 7.

Withdrawing consent

Where we rely on your consent to process personal information, you may withdraw that consent at any time by emailing privacy@maximus.work. Withdrawing consent will not affect the lawfulness of processing before the withdrawal.

Cookies

Most web browsers accept cookies by default. You can configure your browser to reject or remove cookies. Doing so may affect the functionality of the Services.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature you can activate to signal your preference not to have your online activity tracked. No uniform technology standard for recognizing and implementing DNT signals has been finalized. We do not currently respond to DNT browser signals or other automated tracking-opt-out mechanisms. We also do not engage in the cross-site behavioral tracking that DNT signals are designed to prevent.

California law requires us to disclose how we respond to DNT signals. Because no industry or legal standard for recognizing or honoring DNT signals has been adopted, we do not respond to them at this time.

12. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia have specific rights under their state's privacy laws.

We do not collect sensitive personal information for the purpose of inferring characteristics about you. We use sensitive personal information only to provide the Services to you and as otherwise permitted by applicable law.

Sources of personal information

We collect personal information directly from you when you register for and use the Services. We also automatically collect technical and usage information from your device when you interact with the Services. We do not collect personal information about you from third-party sources.

How we use and disclose personal information

See Section 2 (How We Process Your Information) and Section 4 (When and With Whom We Share Your Personal Information). We disclose personal information only to the service providers identified in Section 4 and in the limited additional circumstances described there.

Sale and sharing of personal information

We have not sold or shared (as those terms are defined under California's privacy law and similar state laws) personal information in the preceding twelve (12) months. We commit not to sell or share personal information in the future.

Your rights

Under applicable US state privacy laws, you have the following rights (subject to limitations under applicable law):

  • Right to know whether we process your personal information

  • Right to access your personal information

  • Right to correct inaccuracies in your personal information

  • Right to request deletion of your personal information

  • Right to obtain a portable copy of your personal information

  • Right to opt out of the sale or sharing of personal information for targeted advertising or profiling (Maximus does not engage in these activities)

Request verification

We will verify your identity before responding to a rights request. We will use information you provide only to verify your identity. If we cannot verify your identity from information we already maintain, we may request additional information.

Appeals

If we decline to take action on your request, you may appeal by emailing privacy@maximus.work. We will respond in writing with the action taken or the reasons for declining. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law

California Civil Code Section 1798.83 permits California residents to request, once per year and free of charge, information about categories of personal information (if any) we have disclosed to third parties for those third parties' direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.
